New York's Tax-Debt License Suspension: The $10,000 Line
New York law lets the Tax Department recommend suspension of your driver's license when you have at least $10,000 in past-due, fixed and final tax debt personally assessed against you. The process gives you 60 days from the Notice of Proposed Driver's License Suspension to resolve the debt, after which the DMV sends an Order of Suspension 15 days before it takes effect. Payment in full or an installment agreement stops it, and specific exemptions apply.

The exemptions that block suspension
You are not the taxpayer named, or the debt is paid.
Your wages are already being garnished for this tax debt, or for child or spousal support.
You hold a commercial driver's license.
You receive public assistance or supplemental security income.
Payment would create undue economic hardship, claimed on Form DTF-5.1 with the DTF-5 financial statement.
Keeping the wheels
The clean exits are payment in full or an installment payment agreement; while you comply with an agreement, the suspension is held off. If suspension does land, the DMV can issue a restricted use license for essential driving, which the department points drivers to for work and necessity travel.
The $10,000 threshold counts fixed and final debt, meaning assessments whose appeal windows have closed, one more reason the 90-day deficiency deadline earlier in this decoder matters so much.
License questions
Can New York really take my license over taxes?
Yes. With at least $10,000 in fixed and final tax debt, the department can recommend suspension to the DMV after a 60-day notice period. It is listed among the state's standard civil enforcement actions.
How do I stop a proposed suspension?
Within the 60 days: pay in full, enter an installment payment agreement, or establish an exemption, including the undue economic hardship exemption filed on Form DTF-5.1 with a DTF-5 financial statement. Compliance with an agreement keeps the license safe.
What if I need to drive for work?
A commercial driver's license is exempt from the program outright. For a suspended personal license, the DMV offers a restricted use license for limited purposes, which the Tax Department directs affected drivers to pursue.
