The collection process, decoded

Where are you in the collection process?

A debt in collections moves through recognizable stages, and each one carries different deadlines, different powers on the collector's side, and different rights on yours. Find your stage below; the earlier you engage, the more options you have.

General information, not legal advice. Deadlines are set by the papers you receive and your state's law. If you have been sued, legal aid organizations and court self help centers offer free help.

  1. Missed payments The account falls behind
  2. Charge-off Creditor writes it off, you still owe it What it means and what to do →
  3. Validation notice A collector takes over, your 30 days What it means and what to do →
  4. Lawsuit A summons arrives What it means and what to do →
  5. Judgment The court rules What it means and what to do →
  6. Garnishment Pay or property can be taken What it means and what to do →

Three things that are true at every stage

Deadlines beat arguments

At each stage the strongest move is procedural: dispute inside the validation window, answer the summons by its date, claim exemptions on time. Being right matters less than being on time.

Your rights do not expire

Contact hour limits, the ban on abusive practices, and your ability to demand a collector stop contacting you apply from first call to final garnishment.

Everything is negotiable, earlier is cheaper

Collectors and judgment creditors settle constantly. The same debt generally costs less to resolve at the validation stage than after a judgment adds interest and enforcement.
